Public Tender (the "Public Tender") No. 28/08 For the provision of CONSULTING SERVICES

In connection with Full scale deployment of Energy Performance Contracting in Israeli public sector facilities and Capacity Building for Israeli takeholders

The Ministry wishes to receive proposals from Consultants who meet the eligibility requirements set forth below, for the specialized consulting services related to the Tasks described in the Scope of Work, Appendix "A" to the tender ("the Scope of Work").  procedures for the submission of the proposals, as well as certain general conditions related to the submission and the relationship with the Ministry, the criteria for award of the tender, the Scope of Work and the Consultancy Agreement are all set out in the tender.

General Preconditions for Participation

1.      Submission of a Bank Guarantee for the amount of US$ 50,000, valid up until and including Jan. 31, 2009, as described in the tender documents.

2.      Submission of an affidavit committing the Candidate to use only original software in accordance with the appropriate license, as applicable.

3.      Israeli Candidates must be appropriately registered with the VAT authorities and must submit an affidavit, verified by an attorney, regarding compliance with the laws governing foreign workers and payment of the minimum wage, and compliance with all legal requirements regarding payments of employee social benefits in accordance with applicable Israeli law;

4.      A Candidate must not be precluded by law from participating in the tender, nor, as determinable by the Ministry, be in a situation of potential conflict of interest.

Professional Preconditions for Participation

Subject to a grading system described in the tender, the cumulative eligibility requirements for Candidates hereunder are as follows:

(a)         The Candidate has, in the past five years, served in the capacity of consultant to two or more national governments or international entities with regard to development of  EPC programs or energy efficiency programs in that government’s country or, in the case of an international entity, in the country to which the Candidate was assigned;

(b)         At least two of the programs mentioned in sub-paragraph (a), employed performance contracting methodologies as the leading methodologies for energy efficiency projects;

(c)         The Candidate has, in the past five years, served in the capacity of consultant to two or more national governments or international entities with regard to development of financial tools in support of EPC (as mentioned in Section 1.2(v) above) in that government’s country or, in the case of an international entity, in the country to which the Candidate was assigned;

General Conditions

1.   All Proposals must be submitted to the Ministry, in four copies, no later than November 27, 2008, at 17:00 PM into the relevant receptacle, marked to receive Tender 28/08, at the offices of the Israel Ministry of National Infrastructures, City Gates Building, 216 Jaffa St., Jerusalem, 7th floor.

Each Proposal should be submitted in a sealed envelope (or box) (hereinafter – the "Main Proposal Envelope") marked: "Israel Ministry of National Infrastructures - Public Tender No 28/08; Public Tender for the Provision of Consulting Services in Connection with the Full scale deployment of Energy Performance Contracting in the public sector facilities of Israel"

All other pertinent information regarding submission of proposals, the contents thereof, documentation to be appended thereto, and the relevant procedures are to be found in the tender. Tender documents submitted by post, courier or messenger, are submitted at the risk of the Candidate. The Ministry, under no circumstances, shall be responsible for depositing the submission documents into the relevant receptacle, said responsibility to be at all times that of the Candidate.

NOTE: Submissions made prior to the final date for submission but not deposited in the receptacle shall be disqualified. Submissions made after the closing date and time shall not be opened.

2.   The awarded Consultancy Agreement shall be for an initial term commencing with its execution and ending 31.12.2009, with options for the Ministry to extend the term of the Consultancy Agreement till 31.12.2010, and the again till 31.12.2011. Award of the tender, execution of the Agreement and the extension thereof, as well as "start-work" orders for any of the tasks or sub-tasks, shall be predicated upon there being an available budget.

3.   The Ministry reserves the right to negotiate with the Candidates, or any of them.

4.   The Ministry reserves the right to amend the terms of this tender at any time, or to cancel it, provided that notification of the same is published on the web site of the Ministry – www.mni.gov.il.

5.   The Ministry reserves the right to contract with more than one Candidate.

6.   In the event of any contradiction or discrepancy between this notification and the tender documents, the tender documents shall prevail.
